What Is Fiduciary Deed?
A Fiduciary Deed is executed by a person acting in a fiduciary capacity such as a trustee, executor, administrator, or court-appointed guardian to transfer property on behalf of the beneficiaries. The deed's warranty is limited to confirming that the fiduciary is acting within their legal authority and has not created any encumbrances during their management. Under Section 55(2) proviso of the Transfer of Property Act 1882, a fiduciary seller is deemed to contract only that they have done no act whereby the property is incumbered. Such deeds typically require verification of the underlying court authority or trust instrument before registration.
